Risk Disclosure Policy

This Policy is provided to you (our Client or prospective Client) in accordance with Provision of Investment Services, the Exercise of Investment Activities, according to the Operation of Regulated Markets and Other Related Matters Law 87(I)/2017, as subsequently amended from time to time (“the Law”).

XBO offers retail and professional clients only, contracts for differences (CFDs) across a range of asset classes: FX, Equity, Commodity, Indices, ETFs (Exchange Traded Funds) and Cryptocurrencies. XBO Invest trades are directly booked with the XBO Invest via an online trading platform only, and XBO Invest is the counter-party to clients’ trades. In other words, XBO Invest transacts with clients as principal on the basis of a quote. This means that you must open and close every trade with XBO Invest and cannot close an open trade with a third party. XBO Invest is therefore the sole execution venue for trades executed by it for you.

These terms may be reasonably amended from time to time by XBO Invest and shall apply to any user immediately. XBO Invest shall maintain a link to these Terms and Conditions on every page on the site and state the last date these Terms and Conditions were updated on.

All executed trades are immediately viewable on your account, as is the ‘profit and loss’ associated with closed trades, and as processes are fully automated all sufficient steps are taken to ensure accuracy, which is guaranteed subject to quality of the raw data.

When executing your orders, we will take all sufficient steps to achieve the best possible outcome for you by executing those orders according to this Policy and subject to any specific instructions received from you. This Policy comprises a set of procedures that are designed to obtain the best possible execution result, subject to and taking into account the nature of your orders, the specific instruction you have identified to us in relation to filling of those orders. The client acknowledges that our price may differ from any price which is or might have been available elsewhere.

In providing best execution XBO Invest is required to take into account certain execution factors. Where XBO Invest executes an order on behalf of a client, the best possible result is determined in terms of the total consideration representing the price of the financial instrument and the costs associated with the execution, which must include all expenses incurred by the client which are directly related to the execution of the order.

XBO invest decides which CFDs to make available on the platform, thus by placing an order on the XBO Invest platform, you are providing your explicit consent to your orders being executed outside a regulated exchange or multilateral trading facility (MTF).

XBO strives to provide its customers with the best tools for trading, including introductory guidance for the live trading environment. XBO Invest does not manage or advise on investments.

XBO allows you to trade in highly speculative investments with a significant risk of loss. Such trading is not suitable for all investors, so you must ensure that you fully understand the risks before trading.

You accept that the transactions you perform with XBO Invest may involve financial instruments that are not:

  • Traded on any stock or investment exchange;
  • Readily realizable investments.

Risks associated with the services include:

  • All investment is subject to risk, and the degree of risk is a matter of judgment and cannot be accurately predetermined.
  • Trading in Financial Instruments is generally regarded as involving a high degree of risk compared with other common forms of investment such as recognized collective investment schemes and debt and equity securities.
  • We give no warranty or promise regarding the performance or profitability of your account with us, your investments, or any part thereof.
  • The value of investments and the income derived from them can fall as well as rise and is not guaranteed.

Forex and contracts for differences (CFDs) are speculative and carry risk level, and may not be suitable for all investors. The client may sustain a loss of some or all of the client’s invested capital. The client should not speculate with capital that client cannot afford to lose. The client should be aware of all the risks associated with trading on margin. The client hereby confirms that he is knowledgeable about the above mentioned risks. Never trade with more than you can afford to lose. To avoid incurring large losses, where possible, you should use the risk management tools offered by XBO Invest. Please note you cannot lose more than the balance on your Trading Account.

OPERATIONAL RISKS

Operational risks with XBO Invest on your computer are inherent in every CFD transaction. For example, disruptions in XBO Invest operational processes such as communications, computers, computer or mobile networks or external events may lead to delays in the execution and settlement of a transaction. XBO Invest does not accept or bear any liability whatsoever in relation to the operational processes of XBO Invest, except to the extent that it is caused by the fraud, negligence or dishonesty by XBO Invest.

In connection with the use of computer equipment and data, the Client bears the following risks among other risks, in which cases the Company has no liability of any resulting loss:

a) Power cut of the equipment on the side of the Client or the provider, or communication operator (including voice communication) that serves the Client;

b) Physical damage (or destruction) of the communication channels used to link the Client and provider (communication operator);

c) Outage (unacceptably low quality) of communication via the channels used by the Client, or the Company or the channels used by the provider, or communication operator (including voice communication) that are used by the Client or the Company;

d) Wrong or inconsistent with requirements settings of the Client Terminal;

e) Untimely update of the Client Terminal;

f) The use of communication channels, hardware and software, generate the risk of non reception of a message (including text messages) by the Client from the Company;

g) Malfunction or nonoperative of the Platform, which also includes the Client Terminal. The Client is warned that when trading in an electronic platform.
